Terms of Service

1. Acceptance of Terms

By accessing or using MAGIC at magic.marketinc.agency (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years of age or have the legal authority to bind your organization to these Terms. By creating an account, you represent and warrant that you meet these requirements.

2. Service Description

MAGIC is a business-to-business (B2B) SaaS platform for marketing data aggregation and analytics. The Service includes:

  • OAuth-based connections to advertising platforms for automated data ingestion
  • Automated ETL pipelines for marketing data processing
  • ClickHouse-powered analytics dashboards and reporting
  • Data explorer with CSV export capabilities
  • Connection health monitoring and alerting

3. Account Registration

To use MAGIC, you must create an account using a valid email address. We use email-based one-time passwords (OTP) via Better Auth for authentication. Two-factor authentication (2FA) is available as an optional additional security measure.

Each email address may only be associated with one account. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access.

4. Subscription Plans & Billing

MAGIC offers the following subscription tiers:

  • Starter — $149 USD/month: Up to 3 ad platform sources, up to 10 projects
  • Agency — $349 USD/month: Up to 5 ad platform sources, up to 30 projects
  • Enterprise — $990 USD/month: All available sources, unlimited projects

All subscriptions are billed through Stripe and renew automatically at the end of each billing cycle. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you will retain access to the Service until then. No refunds are provided for partial billing periods.

Founding Partner discounts, where applicable, are honored for the lifetime of the subscription as long as it remains active and in good standing.

CFDI invoices are available upon request for Mexican businesses. A valid RFC (Registro Federal de Contribuyentes) is required. Contact [email protected] to request CFDI invoicing.

5. Free Trial

MAGIC offers a 14-day free trial with full feature access. No credit card is required to start a trial. At the end of the trial period, your account will automatically downgrade to a read-only state. You may subscribe to a paid plan at any time during or after the trial to continue using the Service.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with unauthorized parties
  • Perform automated scraping or data extraction beyond normal API usage
  • Use the Service in any way that violates the terms of service of connected advertising platforms
  • Upload personally identifiable information (PII) of individuals without their consent
  • Use the Service for any unlawful purpose
  • Interfere with or disrupt the Service infrastructure

7. Data Ownership & Processing

You retain full ownership of all marketing data you upload or connect to the Service. By using MAGIC, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you.

Your data is stored in tenant-isolated ClickHouse tables. Each customer’s data is logically separated and inaccessible to other customers. MAGIC does not sell, share, or use customer data for any purpose beyond service delivery.

8. Third-Party Platform Terms

MAGIC integrates with third-party advertising platforms including Meta, Google, TikTok, and LinkedIn. By connecting your accounts, you acknowledge that:

  • You must comply with the terms of service of each connected platform
  • MAGIC accesses data through official APIs using read-only scopes only
  • Changes to third-party platform policies may affect data availability or functionality
  • MAGIC is not liable for restrictions, outages, or policy changes imposed by third-party platforms

9. Intellectual Property

The MAGIC platform — including its algorithms, user interface, design, documentation, and all related intellectual property — is owned by MarketInc Agency. All rights not expressly granted to you are reserved.

Customer data and any reports or exports derived from that data belong to the customer. MAGIC claims no ownership over your data or the insights generated from it.

10. Service Availability

MAGIC is provided on a best-effort uptime basis. We do not offer a formal Service Level Agreement (SLA) for Starter or Agency tier subscriptions. Enterprise tier customers may discuss SLA terms as part of their subscription agreement.

Scheduled maintenance will be communicated via email with at least 24 hours advance notice. We are not liable for downtime or service interruptions caused by our infrastructure providers, including DigitalOcean, Coolify, or Modal.

11. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MAGIC is not liable for any marketing or business decisions made based on dashboard data, analytics, or reports generated by the Service. Dashboard data is derived from third-party platform APIs and should be verified independently.

In no event shall MarketInc Agency’s total liability exceed the aggregate fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.

12. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your account will be deactivated immediately
  • Your data will be retained for 30 days, after which it will be permanently deleted
  • No refund will be issued for any partial billing period

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that is harmful to the Service or other users.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Mexico. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts of Mexico City (Ciudad de México, CDMX).

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to registered users via email at least 30 days before they take effect. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
